Filed Statutes
FROM THE CASE DETAIL SCREEN:
This area allows you to see what formal charges the person was charged with, and the disposition of those charges.
FROM THE MENU: Case, Filed Statutes
Get from another:
This button allows you to COPY the filed statutes from someone else.
- Person to copy from: Click the Get person name button and do a name search for the person you wish to copy from. Click that person’s name.
- Case to copy from: Select the case that has the filed statutes you wish to copy.
Click on the UPDATE button or press ALT+U to save your changes.
The filed statutes will be copied without the plea or disposition being entered. The filed date will default to today’s date and the system will assign a new petition number.
To add a filed statute:
- Count: This will default to 1, then 2, then 3, etc. You can skip this field.
- Suffix: In the event you wish to amend count 1 for example, the new filed statute would be added as Count 1, with a suffix of A.
- Conspiracy/attempt indicator: If the charge is Conspiracy to commit something, or attempted to commit something, or aiding in a crime, please indicate that enhancement here.
- Statute: List statutes containing:
- This is a keyword search. There are hundreds of statutes so we can narrow the list by typing in a keyword such as mischief, or theft. You can also search by statute number.
- TAB, and the search results will appear in the box below. Click on the drop down to see the results of the search. Select the appropriate charge and class.
- Citation number: If there is a number, please add it here.
- Item type: In the event this charge was possession of some sort of drug for example, you can select the drug here.
- Item amount, Item Limit, and Measure: In the event this applies, please complete.
- Classification: Select the appropriate classification, if applicable.
Filed Date:
- This is the date the petition is being filed. It will default to today’s date if left blank.
- If you create your petition in Quest and file stamp it in Quest, the system will automatically change this date to be the date the Petition was file stamped.
Petition:
- Every Petition is assigned a number and counted by the system for statistical purposes.
- Every charge you wish to appear on a specific petition must have the same petition number.
- The multiple petition numbers allow the violations to appear on different petitions than the original charges.
- You can see the different petition numbers displayed under the LIST FILED STATUTES screen.
Date:
- The date the charge is disposed. This should be the date of the hearing where the charge is dismissed or upheld.
To amend a filed statute:
If a charge is amended, you will need to file an Amended Petition. To file an amended petition, you must enter the correct filed statutes.
